Terms of Service
Effective date: June 6, 2026 Last updated: June 6, 2026
These Terms of Service (“Terms“) are a binding agreement between you (“you,” “Customer“) and Hosting Simple LLC, a Delaware limited liability company (“Hosting Simple,” “PanelDNS,” “we,” “us,” “our“), governing your access to and use of the PanelDNS website at paneldns.com and the PanelDNS multi-provider DNS management platform, applications, APIs, CLI, and related services (collectively, the “Service“).
By creating an account, clicking “I agree,” or using the Service, you accept these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind it.
1. The Service
PanelDNS is a control plane that lets you manage DNS zones and records across third-party DNS providers and control panels that you connect. Features available to you depend on your subscription plan as described on paneldns.com.
Changes to the Service. We continually improve the Service and may add, modify, or discontinue features. We will not materially reduce the core functionality of a paid plan during your paid term without giving reasonable prior notice; if we discontinue the Service entirely, we will give you reasonable advance notice and an opportunity to export your Customer Content.
2. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. You must enable available security controls (such as MFA) for privileged users and promptly notify us at security@paneldns.com of any unauthorized access.
Registration information. When you create an account, we collect your name, email address, organisation name, and country, and optionally your company name or website. We also record the date and time (in UTC) at which you accept these Terms and our Privacy Policy, as a record of your consent. How we use this information is described in our Privacy Policy.
3. Connected providers and customer responsibilities
The Service operates on DNS infrastructure that you own or are authorized to manage at third-party providers. You represent and warrant that:
- you own or have authorization to manage each domain, zone, and provider account you connect;
- you have the right to supply us with the API tokens, keys, and credentials you connect; and
- your use complies with the terms of each connected provider.
You are solely responsible for the DNS changes you make through the Service. DNS misconfiguration can cause downtime, email delivery failure, or security exposure. We provide tooling (such as change scheduling, freeze windows, approval workflows, and backups) but do not review or approve your changes.
Shared responsibility. Security and correct operation of the Service are a shared responsibility. We are responsible for securing the platform — the infrastructure, the encryption of stored credentials, and the technical and organizational controls described in our Security page. You are responsible for:
- safeguarding your account credentials and enabling multi-factor authentication;
- the validity and least-privilege scoping of every API token, key, and credential you connect, including third-party DNS-provider credentials;
- rotating and promptly revoking those tokens and credentials — both within PanelDNS and at the third-party provider — when a user leaves, when a credential may be compromised, or on a regular schedule;
- managing your users, roles, approvals, and IP allowlists, and the actions they take;
- the DNS changes you make and their consequences, including testing changes and accounting for propagation delays and registrar/nameserver delegation, which are outside our control;
- configuring DNSSEC correctly, including publishing, updating, and rotating DS records at your registrar, which we cannot perform on your behalf; and
- your compliance with the terms of each connected provider.
We provide tools to help you meet these responsibilities (encrypted credential storage, scoped API tokens, role-based access control, IP allowlisting, audit logs, and credential rotation), but we cannot rotate or revoke credentials issued by third-party providers on your behalf, and we are not responsible for loss or exposure caused by credentials you fail to secure, scope, or rotate, or by changes you make. Backups and point-in-time restore are provided as a convenience and are not a substitute for your own records and change management.
Resellers and provisioned accounts. If you provision, invite, or create accounts, organisations, or sub-client access for other parties — whether directly, through our reseller and white-label features, or programmatically (for example, via the WHMCS module or our API) — you represent and warrant that you have the authority to bind each such party to terms consistent with these Terms, our Privacy Policy, and our DPA, and you are responsible for those parties’ use of the Service as if it were your own. You will ensure that appropriate terms and privacy notices — including the abuse-screening disclosure described in our Privacy Policy — are presented to and accepted by those parties, and you will flow down all obligations necessary for their lawful use of the Service. Where a party you provision is later granted direct access to the PanelDNS portal, that party’s continued use is conditioned on its own acceptance of these Terms.
4. Acceptable use
This section is our Acceptable Use Policy and forms part of these Terms. You agree not to, and not to permit any user or sub-client to, use the Service to:
- violate any law or regulation, or infringe or misappropriate any third party’s rights;
- host, manage, or resolve DNS for domains used for phishing, malware, ransomware, botnet command-and-control, spam, fast-flux hosting, or other abusive, fraudulent, or illegal activity;
- facilitate the distribution of child sexual abuse material, intellectual-property-infringing content, or content that is unlawful, defamatory, or harmful;
- send unsolicited bulk communications, or configure DNS (including SPF, DKIM, or DMARC) to facilitate spam or email spoofing;
- gain or attempt to gain unauthorized access to the Service, other accounts, connected systems, or any data not belonging to you;
- probe, scan, or test the vulnerability of the Service except under our Responsible Disclosure policy;
- exceed, circumvent, or interfere with plan limits, rate limits, quotas, or any technical access controls;
- resell, sublicense, or provide the Service to third parties except as expressly permitted for your plan (for example, white-label and sub-client features);
- introduce malware into, or otherwise interfere with or disrupt the integrity, security, or performance of, the Service or its infrastructure; or
- use the Service to build or train a competing product, or to benchmark it for a competitor.
Export controls and sanctions. You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions or embargo; that you are not identified on any U.S. government restricted-party list (including the U.S. Treasury OFAC Specially Designated Nationals list); and that you will not access or use the Service in violation of any applicable export-control or economic-sanctions laws.
Abuse screening. We use automated abuse-screening tools that check the domain names you add as zones for indicators of phishing and malware. To protect your privacy, this is performed primarily through hash-based local checks, so in the vast majority of cases your domain name is not transmitted to any third party; the technical detail and the third-party reputation sources we use are described in our Privacy Policy. These checks run when a zone is created and periodically thereafter. By accepting these Terms, you consent to your domain names being processed through the third-party abuse-intelligence services identified in our Privacy Policy for the purpose of abuse prevention. Domains used for phishing, malware distribution, spam, or other malicious activity are prohibited and are grounds for immediate suspension or termination. Based on the results of a check, we may refuse to create a zone, suspend an existing zone or account, or flag a domain for manual review; where we suspend a zone or account on this basis we will notify the account owner (and their reseller, if applicable) by email. Automated screening is not infallible — if you believe a domain has been flagged or suspended in error, you may submit an appeal from your dashboard or by emailing abuse@paneldns.com, and we will review it promptly. We may maintain an internal whitelist for domains confirmed to be legitimate.
Enforcement. We may investigate suspected violations and may remove or disable offending content, throttle, suspend, or terminate access — with or without notice depending on the severity and any legal requirement — including in response to valid abuse reports sent to abuse@paneldns.com. We may report illegal activity to law enforcement.
5. Plans, fees, and payment
- Subscriptions are billed in advance on a monthly or annual basis according to the plan you select. Fees are stated in U.S. dollars and are exclusive of taxes, which you are responsible for.
- Auto-renewal. Subscriptions renew automatically for successive terms unless cancelled before the renewal date.
- Payment. You authorize us and our payment processor to charge your payment method for all fees. Failed payments may result in suspension.
- Changes. We may change pricing on at least 30 days’ notice, effective at your next renewal.
- Refunds. Except where required by law or expressly stated, fees are non-refundable. The free plan is provided “as is” without fees.
6. Service levels and support
Support. Support channels and response targets depend on your plan — for example, documentation and community access for all plans, and priority email support on higher tiers.
Uptime SLA. For paid plans that include an uptime commitment, we target the monthly uptime percentage stated for your plan (for example, 99.9% on Pro and 99.95% on Agency). “Monthly uptime percentage” means the percentage of minutes in a calendar month during which the PanelDNS control plane was available, excluding Excluded Downtime. The free plan carries no SLA.
Excluded downtime. The SLA does not apply to unavailability caused by: (a) scheduled or emergency maintenance for which we provide reasonable notice where practicable; (b) factors outside our reasonable control, including a force majeure event or the failure of connected third-party DNS providers, registrars, or networks; (c) your acts or omissions, misconfiguration, or equipment; or (d) suspension or termination under these Terms.
Service credits. If we fail to meet the uptime commitment for your plan in a calendar month, your sole and exclusive remedy is a service credit. Request it in writing to support@paneldns.com within 30 days of the end of the affected month. The credit equals a percentage of that month’s fee for the affected Service: 10% where monthly uptime is below the commitment but at or above 99.0%, and 25% where it is below 99.0%. Credits apply to future invoices, are capped at 25% of the monthly fee, and are not cash refunds.
Overall DNS availability for your domains also depends on your connected providers, which are outside our control.
7. Customer Content and license
“Customer Content” means data you connect, upload, or generate through the Service, including zone and record data, provider credentials, and sub-client and team information. As between the parties, you own your Customer Content. You grant us a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide and improve the Service and as permitted by our Privacy Policy and DPA.
8. Data protection
Our processing of personal data within Customer Content is governed by our Data Processing Addendum, which is incorporated into these Terms. Where you use PanelDNS to manage DNS for your sub-clients, you are the controller and we are your processor.
9. Intellectual property
The Service, including all software, designs, text, and trademarks (including “PanelDNS”), is owned by Hosting Simple or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law.
Feedback. If you send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate it into the Service without restriction or any obligation to you.
Publicity. We may identify you by name and logo as a customer of PanelDNS on our website and in marketing materials, consistent with any brand guidelines you provide. You may decline or revoke this at any time by emailing legal@paneldns.com. Neither party may otherwise imply the other’s endorsement without prior consent.
10. Third-party services
The Service interoperates with third-party providers and platforms. Your use of those services is governed by their terms, and we are not responsible for them. Connecting a provider authorizes us to transmit your instructions and credentials to that provider on your behalf.
11. Beta features
We may offer features identified as beta, preview, or experimental. These are provided “as is,” may be changed or withdrawn at any time, and are excluded from any SLA and warranty.
12. Suspension and termination
You may cancel at any time through your account; cancellation takes effect at the end of the current billing term. We may suspend or terminate the Service immediately for breach of these Terms, non-payment, legal requirement, or risk to the Service or others. On termination, your right to use the Service ends and we will make Customer Content available for export for 30 days, after which we may delete it per our retention practices.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will prevent DNS misconfiguration or provider outages.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTING SIMPLE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, arising out of or relating to the Service, even if advised of the possibility. OUR TOTAL AGGREGATE LIABILITY arising out of or relating to these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Exclusions. The exclusions and the liability cap above do not apply to: (a) your obligation to pay fees due; (b) either party’s indemnification obligations; (c) either party’s breach of its confidentiality obligations; (d) either party’s infringement or misappropriation of the other party’s intellectual-property rights; (e) your breach of the Acceptable use section; or (f) liability that cannot be excluded or limited under applicable law.
15. Indemnification
You will defend, indemnify, and hold harmless Hosting Simple and its affiliates from any third-party claims, damages, and expenses (including reasonable attorneys’ fees) arising from your Customer Content, your DNS changes, your violation of these Terms, or your infringement of any third party’s rights.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction, and the parties consent to venue there, except that either party may seek injunctive relief in any court of competent jurisdiction. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
17. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, provide notice by email or in-product notice at least 30 days before they take effect (except changes required by law, which may take effect sooner). Continued use after changes take effect constitutes acceptance.
18. General
These Terms, together with the Privacy Policy, DPA, and any order or SLA, are the entire agreement between the parties. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to us should be sent to legal@paneldns.com.
Force majeure. Neither party is liable for any delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, internet or power outages, denial-of-service attacks, or the failure of third-party providers or networks.
Survival. The sections that by their nature should survive termination — including Customer Content and license, Intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law and disputes, and this General section — survive termination or expiry of these Terms.
